General Terms and Conditions for Residential Customers (B2C) – Prime Vitality
These Terms and Conditions apply to all agreements, orders and deliveries of Prime Vitality (hereinafter “we” or “us”) regarding products and services offered through our online store to private customers (hereinafter “customer” or “you”).

Article 2 – Applicability.
2.1 These Terms and Conditions apply to all offers, orders and agreements of Prime Vitality regarding products sold to private customers (B2C) through our web store.
2.2 Before placing an order, you are requested to familiarize yourself with these terms and conditions. By placing an order, you agree to these terms and conditions.
Article 3 – The Offer
3.1 All Prime Vitality’s offers on the web store are non-binding and subject to change by us without notice.
3.2 The product information on our website is carefully compiled but may contain inaccuracies. We cannot be held liable for typographical errors or other inaccuracies in the product information displayed.
Article 4 – The Agreement
4.1 An agreement is established when Prime Vitality has received and confirmed your order via a confirmation email.
4.2 After placing an order, you will receive a confirmation by e-mail. This confirmation does not imply acceptance of the order, but is only proof of receipt.
Article 5 – Prices and Payment
5.1 All prices listed on our online store include VAT and exclude shipping costs unless otherwise indicated.
5.2 Payment must be made via the payment methods made available in the online store, such as iDEAL, credit card or other payment methods offered.
5.3 Payments must be made immediately upon placing the order, unless otherwise agreed.
Article 6 – Delivery
6.1 Products will be delivered to the address you provide, provided it is within the Netherlands.
6.2 We strive to ship your order within the specified delivery time, but cannot be held responsible for delays caused by third parties, such as the delivery service.
6.3 The risk of loss of or damage to the products passes to the customer at the time of delivery.
Article 7 – Right of withdrawal
7.1 As a consumer, you have the right to revoke the agreement within 14 days of receiving the products without giving reasons, in accordance with the Distance Selling Act.
7.2 The withdrawal period expires 14 days from the day you receive the products.
7.3 To exercise your right of withdrawal, you must inform us of your decision to withdraw within the withdrawal period by sending a clear message (such as by e-mail) to [email address]. You may also use the model withdrawal form, but this is not obligatory.
7.4 After revocation, you have 14 days to return the products to the following return address: [Return address Prime Vitality]. You bear the cost and risk of the return shipment.
7.5 Products must be returned in unused, undamaged condition in their original packaging.
Article 8 – Exclusions from Right of Withdrawal.
8.1 The right of withdrawal is excluded for the following products:
Products that cannot be returned for hygienic reasons, such as opened supplements or health products.
Products that are personalized or customized for the customer.
Products that have been opened or used after delivery.
Article 9 – Refund
9.1 Upon receipt of the returned products, and provided that the return conditions have been met, you will receive a full refund of the purchase price within 14 days of revocation.
9.2 Refunds will be made via the payment method you used when ordering, unless otherwise agreed.
9.3 Return shipping costs are the responsibility of the customer unless otherwise specified.
Article 10 – Warranty and Defects
10.1 We guarantee that the delivered products comply with the agreement and are in good condition.
10.2 If the delivered product is defective or does not comply with the order, you may file a complaint with Prime Vitality within 2 months after the discovery of the defect. Upon approval of the complaint, you are entitled to a replacement product or refund.
Article 11 – Liability
11.1 Prime Vitality shall not be liable for damages resulting from the misuse of the products unless such damages are the result of Prime Vitality’s intentional or gross negligence.
11.2 Prime Vitality shall not be liable for any indirect damages, such as lost profits or lost savings, resulting from the delivery or use of our products.
Article 12 – Privacy and Personal Data
12.1 Prime Vitality processes your personal data in accordance with privacy laws. For more information, please refer to our privacy policy on our website.
Article 13 – Applicable Law and Disputes.
13.1 All agreements with Prime Vitality are governed by Dutch law.
13.2 Disputes between Prime Vitality and the client will initially be submitted to the competent court in the Netherlands, unless otherwise stipulated.
Article 14 – Changes to the General Conditions
14.1 Prime Vitality reserves the right to modify these Terms and Conditions at any time. We will publish changes on our website in a timely manner. The amended terms and conditions are effective from the time of publication, unless otherwise indicated.
